We — Rago Wright, LLC, a Delaware limited liability company (“Rago Wright, LLC”, “we”, or “us”) — operate a mobile messaging service (“Service”) to communicate with our customers and with people who consent to receive messages from us.  Your use of the Service constitutes your agreement to these SMS TERMS AND CONDITIONS (“Mobile Terms”).

YOUR CONSENT

Any communication you have with us - through our website, by phone, by email or by mobile carrier/SMS — in which you consent to receive messages from us by text, SMS or mobile carrier will constitute your prior express written consent to all of the following:

  • to receive text messages from us until you opt out of further text messages;
  • to receive text messages to the phone number you supply to us even if that phone number is on a Do Not Call List;
  • to receive text messages from us even when they are marketing or promotional text messages about our products and services, updates, alerts, specials, abandoned shopping carts, incomplete bid forms, follow-ups to lots and products on which you have indicated an interest or examined on our website, sales, new items, discounts and new offerings;
  • to receive text messages that enable us to complete, fulfill, finalize or otherwise deal with your inquiry or order about products, services, sales, sale openings, lot openings, or notifications that you have been outbid, invoice availability or our other activities.


DATA CHARGES & YOUR DATA SERVICE

You may incur charges from your wireless, phone or data provider due to text messages you receive from us.  You are solely responsible to pay for any text messaging or wireless charges incurred by you or by a person who has access to your wireless device or telephone number. Check your mobile plan and contact your wireless provider for details. If you do not want to incur these costs, please opt out of our text messages.  If your carrier does not permit Text Messages, you may not receive our Text Messages.

YOUR CHOICE

Providing this consent to receive text messages from us is solely your choice and is not a condition for purchase. You may opt out of receiving further marketing or promotional messages from us at any time.

HOW TO OPT OUT

You can opt out of receiving any further text messages from us at any time by:

  • replying STOP to any Text Message you receive from us
  • Texting STOP to (210) 749–5603
  • clicking the unsubscribe link (where available) in any text message to cancel.

Once you opt out, you'll get an opt-out confirmation text message – but you will receive no further promotional messages to your mobile device or phone number, unless you consent to more messages.

However, if you order any products from us, request information from us or solicit services from us, we may send you transactional text messages about your order, request or solicitation.

If you have signed up for messages from Rago Wright, LLC using more than one phone number or contact method, you will need to opt out separately for each phone number or contact method.

You agree that we are not responsible or liable for messages that are delayed or misdirected or not received, for any errors in information in any message, and/or any action you may or may not take in reliance on information in any message, to the extent permitted by applicable law.

You are responsible for keeping the phone number we have for you up to date and accurate.

We may also modify these Mobile Terms at any time. If we do, we will post the modified Mobile Terms on our website and your use of the Service is your agreement to the modified Mobile Terms.
